Labour market test

Any employee employed in Poland who is not an EU citizen or any EEA country must be in possession of a work permit for a foreigner. It is up to the employer to apply for a work permit for a foreigner. However, this is not the only document he needs to obtain. Written information from the old man is also necessary, i.e. the so-called labour market test. The point is that it is only possible to employ foreigners in 2020 if it is found that there is no employee in the unemployment register who meets the requirements of the employer. The starosta has 14 days from the submission of the request for information.

When is a labour market test not necessary?

There are some exceptions where a labour market test is not needed. A work permit for a Ukrainian or other foreigner does not require information from the old man when it concerns a doctor, sports coach or foreigner is authorized to represent a foreign company in Poland.
